Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.
However my wife is applying again and taking letter with her from attorney stating that reason was invliad.
I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.

Hi All,
How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

My Lawyer also suggested that we apply Porting PD after the second I 140 gets approved instead of doing it at the time of applying for second I 140.

I used Ap in 2007 and than I filed H-1B extension 6 month prior to my H-1B expiring in sept 2008. which was approved with the sameI-94 as on parolee status.
I want to use AP again, is there any problem.
Has anybody done that.

Hi, Im a pediatritian from Venezuela. I was hired by a research institution to work for a year here in the US, and i was granted a H1b non clinical Visa about 3 months ago. A month ago I was offered a position on the fellowship program of Pediatric Critical Care at the same institution but they need to change my visa to a Clinical H1b visa. I went to all the process here in the US. I havent go to Venezuela to get my passport stamped but at the International Depatment of the Institution they told me that i can Travel to Mexico or Canada for less than 30 days without my passport stamped, no problem. I have plans to go to Mexico for Christmas. Now my question is:
Can I travel to Mexico with my first H1b visa aprooval while my other H1b visa is on process?

I may be ignorant here but why do you have 2 I-94s? Your I94 is invalid once you leave the country. So I would think the number on the latest and current I94 is the number you would use.

I am a physical therapist licensed to practice in michigan.i also have eligibility letter ( for pennsylvania)-pa does not issue license without ssn number.
i am in usa on H4.
can i self sponser my green card under national interest waiver.
i am originally from india.

My mother is a GC holder since 91. I came to US in 2002 on F1 and then H1 and now GC.
Will the fact that my mom was a GC holder and I did not use that impact my GC? I have answered all the questions correctly(true i mean) always.
