Good Morning,
I would like to ask some questions about changing jobs. I am currently on a second H1-B, and have applied for a green card (Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS). The company�s attorney sent me the following form as a receipt: I797C application to adjust to permanent resident status.
If I decide to join a new company, what do they have to do? Can I change jobs keeping my current H1-B? Do they apply for another H1-B and then restart the green card process? What documents are required to port my current priority date?

yes. its possible. i had my 140 denied and i wanted to know everything about my case from labor to 140denial to appeals. I filed FOIA and USCIS sent me everything on a CD.

It has to be 693 as per my understanding. The doctors usually have their versions of 693, in multipart (3-4). I think the 4th part is green and is intended to be your copy. Along with 693 there is a supplement page for vaccinations etc.

Hello Guys,
I need urgent help regarding my EAD.
I received my EAD after long wait 5 months .... and now it is valid just for 2 months :mad:
where as my I94 is valid till Oct 2011 and so as my husband's.
I called service center and they said that , if I feel there is an error with my card, I will have to send it back and USCIS will correct it if they feel the same and there is no time line for correction..
I need an advice on what should I do - send it for correction or file extension? I already have a job starting soon and I am scared that If I don't get it back in two months I will not be able to take it....
PLEASE HELP...

Looking for a lawyer that is somewhat familiar with the Child Status Protection Act to answer some questions. If you are in the NYC area and would prefer I pay a fee, please PM me. My father filed his Labor Cert. in Aug 1996. I was 19 at the time. He then filed his I-140 on July 2000, and his I-485 on Dec 2000. He received his Greencard in August 2001. I was 24.
According to this faq from Shusterman: http://www.shusterman.com/hr1209-faq.html
the new law provides that she would be automatically reclassfied to an appropriate category, presumably family-based 2B, and that she retain her father's original priority date. This would be the date that his employer submitted the labor certification application.
Does this apply to me? According to this, would I retain my father's Priority Date of Aug 1996? I currently have an approved I-130 with a priority date of Jan 2002 under F2B which my father filed after he got his greencard.

Call Customer Service. Phone no. is provided on any of your recipt notices. These is an option for typos on the document, when you call them. Tell them and they will open a Service Request, and update your name either when you go for fingerprinting or immedately. Mostly, they will open service request. You should also get an email confirming the Request made by you within few days (When I called for my typo, they said witin 45days, but got the mail within 15 days). Take that email with you if you get it before fingerprinting.

Hello,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

I had already gotten my USDOS approval and my USCIS approval for my J waiver. The whole process took less than a month which surprised us! But it was stated on the I-797 that I should start working for my employer within 90days from March 19, which will be June 19. The problem is my training program does not end until June 30. Even if I wait until June 19 to file for my H1B, and if I don't go for premium processing, once they approve it and retro-date it, there will be an overlap from June 19-30. Can I apply for the H1 on June 30 instead (when my J expires) but that will be more than 90 days from March 19? I will appreciate any suggestions. Thanks!

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.
Any input is appreciated. Thanks in advance guys.

I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien or not; and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?
